Estate Litigation
It’s always difficult when a loved one passes away.  It becomes more difficult when disagreements arise about the estate.  If the executor isn’t following the terms of a will, we can make sure you receive what you’re entitled to and your loved one’s wishes are respected.  If you feel the will may have been the product of duress, we may need to examine a power of attorney to make sure nobody took advantage of an ill person.

Undue influence over an ill person may have occurred when someone has exerted pressure against the person’s will, making them feel as if they have no choice in the matter. Most situations, however, are not so clear and require the expertise of an experienced law firm to investigate the underlying circumstances thoroughly. Evidence to suggest such a situation may include but not be limited to:

  • Confidential relationship between testator and beneficiary of will
  • Suspicious circumstances surrounding the execution of the will
  • Assets “hidden” in joint accounts or payable on death accounts

Depending on the particular situation, it is possible to have to have such a will nullified.  Let La Corte, Bundy, Varady and Kinsella remove any unnecessary legal stress related to a loved one’s passing and help ensure his or her last requests are truly honored.
